court produced by the NRI husband since in any case the FIR had been lodged by the wife prior
to the UC court’s decree.

Nonsense
1) NRI’s can divorce in the US or anywhere
The laws of the country are applicable to all people living in the country irrespective of being a citizen or not. To get the jurisdicaiton of a court, you need to meet residency requirements of that court.
2) Divorce in US is valid in India as long as it is not obtained by fraud, as long as the wife (the defendant) is living in the US and has been properly served.
3) US laws are fair , unlike indian laws which favour the woman. They usually prohibit the child to be taken outside the US. So to prevent the father from seeing the child, an Indian woman will file false 498a case against the father and prevent him from contacting the child. FBI will issue arrest warrant for the woman. Any man marrying such a woman has the risk of his life being ruined as FBI will always be on his wifes tail.
4) Red corner notices are sent out to drag such women where ever they go.
5) Whereas Red corner notice given to 498a’ed men will be used to wipe toilets in Interpol offices, as even Interpol knows this is bullshit by scheming indian women.
6) Nothing happens to your job or anything as even the state department knows that this misuse of law is happening has issued a warning asking its citizens to be careful while marrying Indian women.

April 21: Interpol, which issues Red Corner notices to arrest criminals all over the world, has stopped issuing notices pertaining to Section 498(A) (dowry harassment) cases registered in India. There are about 3,000 requests for red corner notices from Indian government pending with Interpol.
The inspector-general of CID, Mr S. Umapathi, said there are as many as 120 cases from Andhra Pradesh pending with Interpol for the past eight months.Sources in the CBI said Punjab tops the list with nearly 300 cases.
According to sources, there is no law pertaining to dowry harassment in US and other developed countries and hence the Interpol is in dilemma whether they can issue Red Corner notice based on the Indian law.
“The mater has been discussed with US embassy officials recently. However, there was no improvement in the status,” Mr Umapathi said. “There was no delay in other criminal cases,” he added.
The external affairs ministry had sent several representations to Interpol explaining the seriousness of the cases booked under Section 498 (A). However it failed to get any positive response from them.

Interpol is just an organisation and has no legal judiciary of the people living in US (irrespective of their status-H1/B1/L1/F1/H4/green card/citizen), so folks dont worry and loose your sleep on this minute feud, irrespective of your US status, if your are on H-1 your green card proceedings wont get effected due to 498A Interpol RCN.
The following ruling pertains to extraditing an Indian citizen from India based just on an Interpol Red Corner Notice without the foreign government having issued a request for extradition.
In its present form, it would not apply to a foreign citizen hiding in India (several of whom have been extradited) or an Indian citizen hiding abroad against whom a RCN has been issued.
“the Supreme Court has ruled that an Indian citizen locked in a “matrimonial dispute” cannot be extradited to another country, as a “matrimonial dispute does not constitute an extraditable offence.”
The apex court recognised that the husband violated US laws. “The husband came to India with the child in 2006 and in violation of US custody orders.” But the SC held that merely the issuing of a “Red Corner” notice by a court abroad doesn’t mean the arrest of the person is required. The foreign government needs to issue a request for extradition, which hasn’t been done in this case.”

New Delhi: Ashwin and Dina Patel (names changed) got married in Mumbai in 2002. Soon after, they moved to the US and there, had a daughter, Seema. In 2005, Dina, on grounds of abuse, obtained an order of judicial separation from Ashwin from a US court. The court granted interim custody of Seema to Dina, and access to the child to Ashwin.
After Ashwin returned to India with their daughter, Dina filed a case against Ashwin in the US accusing him of kidnapping Seema. Consequently, the US police issued two arrest warrants against him: a custody violation warrant, and a kidnapping felony warrant. A Red Corner notice was also issued against Ashwin by Interpol, which was recently upheld by the Bombay High Court after a petition was filed by Ashwin seeking stay on the warrants and notice.

Hi, Everyone talk about India development recently, but these one sided laws 498a IPC and Domestic Violence law must be changed in the Indian Parliament without any delay. We must write to the President, Prime Minister, Women and child Welfare minister, and all the Members of the Parliament and members of the opposition MPS We have to discuss these issues whenever there is a opportunity with the higher authority personell in the Indian government.

We got Married 05/30/2002, and have a daughter born 09/07/2005. My wife and she’s family given me 498a/34 IPC, it’s not true case, believe me. My wife are engaged/Affair with a boy his house front of my house, all the matters are know every person in my village, and now they support to me and they told me if necessary then they given command in court and also they given me written about my character. When my wife goes outside form my house near about 18.6 vory gold and cash 1.20 lack Indian rupees taken. Not taken my daughter she is now in my house. My wife doing the 498a case’s date 31/08/2009 and I arrest 06/09/2009, court give me bail at 19/09/2009 my 1st court date is done 16/10/2009 Barashat court. My next court date is 04/01/2010 Barashat court. Some proof has me about my wife and the boy that they are in illegal relation(Like S.M.S. C.D. Photo). Believe me I and my family love much more to my wife. They (My wife family) are very very poor and live in a bosti, my mother see 1st time and she arrange my marriage, Mother told me they are very poor so what? After marriage she is my family member, believe me not a single word is wrong. My wife, she’s family and the boy they are misusing this law. She want to marry to the boy. I don’t file any case about the matter, I take a lawyer his ph. No is: 033 30127001. Now my families all members are destroyed. I don’t know what happened next? Now my wife’s family wants to come my house but I’m not agree. I went to punishment. If possible please help me.
